Certainly, if we had a million subscribers it would be a lot more difficult to be left relatively unmolested, with only sporadic interference.  We would probably get the AP treatment.  It's the principle though, not the numbers.

Far as the alternate definition of knowing it when you see it being arbitrary, if it's good enough for the SCOTUS, it's good enough for the Diner.

Really? Good enough for SCOTUS works for the Diner? I'll keep that in mind as their decisions continue to come out and we'll see how wonderfully "good enough for SCOTUS, good enough for the Diner" works out overall.

The converse isn't necessarily true.  What is good enough for the Diner may not be good enough for the SCOTUS.
